Employer Retaliation is Illegal

Employers are prohibited from retaliating against employees who file complaints of discrimination. While this rule may provide some comfort, employees must realize that in the real world, retaliation in some form may occur. If good faith efforts within the employer’s internal complaint procedure, fails to address the substantive issues in the complaint, the employee may proceed to file a formal complaint of discrimination with either the Equal Employment Opportunity Commission and or the Florida Commission on Human Relations. A formal complaint of discrimination must be filed with the Equal Employment Opportunity Commission within 300 days of the last act of discrimination; or with the Florida Commission on Human Relations within one year of the last act of discrimination.
